GAPCO Packaging Machinery Service Terms and Conditions

 

Effective Date upon customer signing GAPCO’s Service/Installation Form

 

  1. Service Description:

 

1.1 Scope of Services:

 

Gulf Atlantic Packaging Corp. (“Service Provider”) offers comprehensive machinery installation, maintenance, repair, and diagnostic services to its customers (“Client”). These services include but are not limited to:

– Equipment Installation

-Routine maintenance checks

– Emergency repairs

– Machinery optimization and adjustments

– Technical support and consultation

 

1.2 Service Specifications:

The specific details of each service, including the machinery involved, tasks performed, and any additional materials required, will be mutually agreed upon by the parties prior to the commencement of each service appointment.

 

  1. Rates and Payment:

 

2.1 **Service Rates:**

 

Client agrees to pay Service Provider for the services provided at the following rates:

 

Installation & Training

– Hourly Rate: $150.00

– Additional Costs (if any):

– Travel:

– Hourly Rate: $75.00

– Additional Costs (if any):

– Per Diem:

– Daily Rate: $75

– Additional Costs (if any):

 

2.2 **Payment Terms:**

 

Client agrees to the following payment terms:

 

– Invoices will be issued after the completion of the service.

– Payment is due within 30 days of the invoice date unless stated otherwise.

 

2.3 Late Payment:

 

Client understands and agrees that late payments may be subject to credit agency reporting services.

 

  1. Booking and Cancellation:

 

3.1 Booking Confirmation:

 

Service requests should be made by the Client in advance. Service Provider will confirm the booking in writing or via email, specifying the date, time, and details of the scheduled service.

 

3.2 **Cancellation Policy:**

 

If the Client needs to cancel a service appointment, they must provide at least 7 days’ notice. Failure to do so may result in a cancellation fee of the hard costs associated with any cancelation being charged to Gulf Atlantic Packaging Corp.

 

  1. Warranty:

 

4.1 Service Warranty:

 

Service Provider warrants that all services will be performed in a professional and workmanlike manner consistent with industry standards. If the Client is dissatisfied with the services provided, they must notify Service Provider within 24 hours of the service completion date. All machine warranty work must be completed by an authorized Gulf Atlantic Packaging Corp. certified service technician. Any service performed from an unauthorized service technician resulting in damage to the machine/system may result in a void in the machines warranty respective to where the damage is caused.

 

Any service performed to a machine/system provided by Gulf Atlantic Packaging Corp. that is neglected, abused, misused or serviced by an unauthorized service technician may result in a void in the system’s warranty. If Gulf Atlantic Packaging Corp. is summoned to service said equipment that falls under these underlying stipulations, the customer agrees to pay the service rates outlined under section 2.1.

 

4.2 Limitation of Liability:

 

Service Provider’s liability for any damages arising from the provision of services shall be limited to the total fees paid by the Client for the specific services in question. In no event shall Service Provider be liable for any consequential, indirect, or incidental damages.

 

  1. Confidentiality:

 

Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the provision of services. This includes but is not limited to, technical specifications, trade secrets, and any other sensitive information.

 

  1. Governing Law:

 

This Agreement shall be governed by and construed in accordance with the laws of the state of Georgia. Any legal action arising out of or related to this Agreement shall be brought in the appropriate state or federal court located within the state of Georgia.

 

  1. Entire Agreement:

 

This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings, agreements, or representations.

 

  1. Modifications:

 

Any modifications to this Agreement must be made in writing and signed by both parties.
